TERMS AND CONDITIONS OF SALE

1. All orders are accepted under the following terms and conditions which constitute a legally binding contract. Customers are advised to read this carefully before signing. Orders can only be accepted if fully completed including the tick boxes and signature. Tanalised Timber is treated in a way in which treatment is forced into the timber under extreme pressure in a treatment tank, due to this, pressure-treated timber only dries out once installed. During the drying out period, timber can leak via knots and shakes in the wood, moisture can drip from the roof and beams whilst drying out, this process depending on the time of year can take a few weeks to settle, this is perfectly normal and is not a fault and is not detrimental to the building.

IN HEAVY PERSISTENT RAIN GARDEN BUILDINGS ARE NOT 100% WATERTIGHT, TIMBER BEING A NATURAL PRODUCT IS POROUS AND AFTER PROLONGED SATURATION WILL START TO SOAK IN WATER THROUGH THE CLADDING, THE CONSUMER MUST APPLY A HIGH-PERFORMANCE, OIL-BASED WATER-REPELLENT STRAIGHT AFTER INSTALLATION AND ANNUALLY THEREAFTER TO HELP ALLEVIATE THE EXTENT OF WATER INGRESS, HOWEVER EVEN AFTER APPLYING A REPELLENT, WATER MAY STILL SOAK THROUGH DEPENDING ON THE EXTREMITY OF THE WEATHER. THIS IS NOT A FAULT AND NO CLAIM WILL BE ENTERED INTO. IN WINTER WHEN THE WEATHER IS VERY DAMP AND WET, OCCASIONALLY MOULD AND DEW CAN APPEAR INSIDE THE BUILDING. THIS IS DUE TO DAMP MOISTURE IN THE AIR, THIS WILL NOT HARM THE PERFORMANCE OF THE BUILDING IN ANY WAY AND CAN GENERALLY BE WIPED OFF WITH A CLOTH, ONCE THE WEATHER WARMS UP ANY MOULD WILL NORMALLY DISAPPEAR.

2. A 15% non-refundable deposit is required to secure order. The remainder of the balance is due 7 days before delivery.

3. We will use all reasonable efforts to keep to the advised delivery date. In certain circumstances, these may be subject to strikes, shortages of labour, adverse weather, pandemics, breakdown of machinery or transport and other factors beyond our reasonable control, we reserve the right for a reasonable extension of time in such cases. Notification of such changes will be made as soon as possible. We cannot be held responsible for loss of earnings etc.

4. Delivery is arranged at the convenience of the company in agreement with the customer. While it is not possible to give accurate times, the office number is available for a rough estimate of installation time on the day. It is the customer’s responsibility to ensure receipt of the building. In the event of the customer being unavailable to accept delivery, the correct layout is to be marked out for the fitting team. We cannot be held responsible for the building being assembled in the incorrect position. In the event of the customer’s failing to keep to arrangements which make delivery impossible, we reserve the right to charge a call-out fee of £150.

5. Upon delivery, if any parts are lost or damaged we will either repair them or replace damaged components with new ones free of charge; this is at the discretion of the management. This is providing notification of such shortage or damage is made in writing within five days of delivery. Your statutory rights are not affected.

6. Erection of your building: A solid level base must be provided of the correct size of your building. In the event that the base is not suitable our erectors will neatly stack the building on your property or if agreed by us, will arrange for storage and redelivery, in which case you will be charged at our recall rate of £150. It is your responsibility to correct the base before we return to complete the installation. No responsibility will be accepted for buildings erected on uneven bases.

7. Bases – if your flag or concrete base is larger than the shed you will get a considerable amount of splash back on the bottom part of your garden building this can lead to the cladding being wet over a prolonged period and eventually water will start to soak into the timbers. we recommend either the use of guttering to divert the flow of water and stop the constant splashing or raising the building onto bearers. These are only recommendations which we know will help, however, we are not liable for problems arising from the customer’s base.

8. Specifications, these are correct at the time of publication but are subject to alteration or withdrawal at any time without notice. As our policy is to constantly seek to improve quality, design and service, we reserve the right to amend, alter or change materials used at our discretion when such changes may be deemed desirable or necessary.

9. We reserve the right to cancel or amend delivery dates at short notice due to adverse weather, mechanical breakdown, supply chain delays, staff disputes, sickness, traffic or any unforeseen circumstance out of our control. We are not liable for any costs incurred, loss of earnings or other losses in relation to a late, amended or cancelled delivery.

10. Returns: This returns policy applies to orders placed via the Internet or telephone orders only. Your intention to return your purchase must be made in writing to our customer services team at: sales@kjsgardenbuildings.co.uk. The product must be unused and returned to us within 14 days of purchase. We will not accept any product for return if it has been assembled, modified or customised in any way including being subject to the application of chemicals or paints. Orders which are cut and custom-made to your requirements will not be exchanged or refunded. It is your responsibility to arrange for the product to be delivered to the said returns address. If you return a part of an order, we will recalculate any applicable delivery charge for the remaining part of the order and also deduct this from the refund. We reserve the right to refuse a return if the product is not in the condition it was delivered and to ask for proof of purchase, eg: order number/delivery date. You will receive a full refund of the price paid once the products have been accepted and they have been deemed to be in the original delivery state.

11. The purchaser will provide fair and reasonable access to the installation site. Due to health and safety legislations, building components cannot be carried over garage roofs, fences, hedges etc. or be built off ground level. Please consider the dimensions of the building when placing your order. Most buildings will not fit through a standard house door. It is the customer’s responsibility to ensure the correct size building is ordered. Any building which does not at the time of installation will be left on the customer’s property and not be returned to the supplier.

12. Timber is a natural product that needs care and maintenance and is subject to naturally occurring changes which we have no control over caused by weather conditions, splits, warping and knot holes can occur. This is beyond our control and no liability will be accepted if this happens. To minimise expansion and contraction it is essential to maintain your building. To prevent this we recommend the application of a spirit (oil) based wood preservative upon installation and annually thereafter. Some movement may happen after delivery and this is beyond our control.

13. Doors – Timber being a natural product can warp we provide 2 turn buttons on all doors which must be used to secure the door when the door is closed to help stop doors warping in climate change, however this is a preventative and not a cure, doors may still warp as timber is a natural product, this is beyond our control no liability can be accepted.

14. Joiner-made doors & windows – Joiner-made doors and windows are silicone sealed, however, heavy rainfall can penetrate after some time, so no liability can be accepted unless a manufacturer fault is found.

15. 10-Year Anti-Rot Guarantee – All our Tanalised Timber Buildings come with a 10-year Anti-Rot Guarantee. To keep your Guarantee valid the building must be treated annually with a high-performance oil-based water repellent which is suitable for use on tanalised timber. Please note this is an Anti-Rot Guarantee ONLY and does not guarantee any other aspects of your building.

16. Roofing felt – we use a mineral felt supplied to us from 3 main UK felt manufacturers made for use on garden sheds. Occasionally the felt can wrinkle. This is due to temperature changes and is not a fault with the product and no claims will be entered into if this happens. The manufacturers of the standard felt do not offer a guarantee for this product, so we as a company are not able to pass any guarantee onto our customers. WE CANNOT GUARANTEE THE STANDARD SHED FELT against leaking, or (damage caused by extreme weather such as storms and very high winds), we recommend upgrading to a heavier-duty Poly Felt which has a 1 Year Guarantee from the date of installation. (Does not include damage caused by extreme weather conditions see paragraph above)

Any modification or customisation made to any building supplied by KJS Garden Buildings will result in your warranty being void.
